1. Eligibility

1.1 Age Requirements

Attendees must be at least 17 years old, or 16 years old if eligible for the full mobility component of the Personal Independence Payment (PIP).

1.2 Licence Requirements

You must hold a valid UK or Northern Ireland provisional or full driving licence. Proof of licence must be provided prior to the start of your course. Failure to do so may result in course cancellation without refund, due to instructor time and resources already committed.

2. Course Bookings, Cancellations & Cooling-Off Rights

2.1 Booking Confirmation

Your course is confirmed once full payment is received and acknowledged in writing by 5DAY®. By submitting payment, you agree to be bound by these Terms and Conditions.

2.2 Cooling-Off Period

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your course within 14 days of booking, provided the course has not commenced.

Cancellations by telephone are not accepted.

After the 14-day period, cancellations and refunds are no longer permitted, except as outlined in Section 2.4.2.3 Short-Notice Bookings

For bookings made within 14 days of the course start date, you have a 7-day cancellation period provided it does not overlap with the course start date.

If cancelled within this window, an administrative fee of £50 + VAT will be deducted from your refund.

2.4 Cancellations or Changes After Cooling-Off Period

You may cancel or reschedule your course only by providing a minimum of 20 days’ written notice.

Courses may be rescheduled up to three times within a three-year period.

Once rescheduled, you waive your right to a full refund.

Prices are subject to inflationary increases.

Cancellations within 20 days of the course start date are non-refundable due to non-recoverable instructor fees (up to £1045).

Exceptional circumstances (e.g. serious illness) may be considered, but refunds are not guaranteed.

3. Course Format and Attendance

3.1 Course Duration

Courses run over five consecutive days, either in-person or online (location dependent). 5DAY® reserves the right to adjust course format, times or content due to unforeseen circumstances.

3.2 Course Timetables

Refer to your course confirmation email for your specific timetable.

“A” Course: 10:00–14:30 (North London and Ipswich: 09:00–13:30)

“B” Course: 14:30–19:00

Online theory training: 16:30–18:30 (times may vary)

           “B” Course Online theory training: 10am –12pm

3.3 Attendance Requirements

You must attend punctually each day. No additional time or refunds will be provided for lateness, absence or early departure.

Disclaimer: Our courses are intensive and fast-paced by design. As such, they may not be suitable for all individuals, particularly those who may experience difficulty with sustained focus, high- pressure learning environments or accelerated instructional formats. Prospective participants should carefully consider their ability to meet these demands before enrolling.

4. Training and Instructor Standards

Driving tuition is provided by DVSA-approved instructors under national training standards. We aim to prepare pupils for their practical test within five days, but test-readiness is not guaranteed and varies by individual. Any additional tuition or instruction beyond the scope of the original course must be arranged directly between the learner and the instructor.

5DAY® accepts no responsibility or liability for any such private arrangements, including but not limited to payment, scheduling or instructional outcomes as they fall outside the terms of the original course agreement.

5. Theory Test

5DAY® will book your first DVSA theory test at the current government rate. You must bring your UK provisional photo licence to the test.

6. Free Theory Retraining

If you fail your theory test, you are eligible for unlimited free retraining sessions (online or in person where available) during scheduled hours.

7. Practical Driving Test, Car Hire & Limitations

7.1 First Driving Test

Each course includes one complimentary driving test booking service, which must be requested by submitting the FT26 form within 24 months from the course start date. Failure to submit the FT26 form within this timeframe will result in the forfeiture of the complimentary test service and any related services, including vehicle hire and instructor support. This condition is enforced in accordance with applicable UK consumer law.

Conditions of Redemption:

Request must be submitted within 24 months of course commencement.

Active participation (attendance, communication, engagement) is required.

All rights are forfeited after 24 months, with no further liability on 5DAY®.Test Availability: Due to ongoing DVSA test backlogs, 5DAY® does not & cannot guarantee the availability of a practical test within a specific timeframe. While we will make all reasonable efforts to assist with the booking process, please note that 5DAY® is unable to use third-party services, including cancellation apps to secure earlier test dates.

We strongly recommend that pupils independently explore and use reputable cancellation services or apps to potentially secure a faster test date than may be available through standard DVSA channels.

Notes: No cash alternative or refund is provided if:

You book your own test

You supply your own vehicle for the test

5DAY® is unable to secure a test due to DVSA delays

7.2 Vehicle Use for Practical Test

A 5DAY® training vehicle may be provided free of charge for your first driving test, subject to:

Passing your theory test

Instructor approval that you are test-ready and safe to proceedNo refund will be given if you choose not to use this service. If your test is cancelled by the DVSA with less than 3 working days’ notice, the complimentary vehicle use is forfeited.

We reserve the right to withhold the vehicle if the instructor reasonably believes you pose a risk to yourself, others or public safety. This decision is final and not subject to appeal. You will be notified in advance.

8. Mentoring & Retest Programme

If you fail your first practical test and wish to qualify for the complimentary mentoring programme, your DL25 test report must be submitted within 7 days of the test date. Submissions received after this period will not be eligible for inclusion in the programme.

Retraining focuses on addressing serious or dangerous faults identified.

The mentoring programme concludes once your instructor has assessed your progress and confirmed that you are test-ready.

Eligibility for this benefit is conditional upon the successful completion of the full 5DAY® course. Partial attendance or incomplete participation does not qualify.Retest Fees:

DVSA Test Fee: £62Any fees paid to 5DAY® for driving tests are collected on behalf of the DVSA and are forwarded in full. 5DAY® does not retain any portion of these fees or derive profit from them.

9. Promotions and Offers

No adjustment is available for courses purchased at alternative prices.

10. Data Protection and Privacy

10.1 GDPR ComplianceWe comply fully with the UK General Data Protection Regulation (UK GDPR). Your data will only be used to:

Deliver your course

Book theory and practical tests

Liaise with instructors and the DVSA

10.2 Instructor Contact

Your name, driver number, email and mobile number will be shared with your assigned instructor solely for coordination purposes. Instructors are contractually required to delete your data after the course concludes.

11. Complaints Procedure

11.1 Reporting a Complaint

Any complaints or concerns must be raised during the scheduled course week to allow sufficient time for investigation and resolution.

As a condition precedent to any further action, you must give 5DAY® a reasonable opportunity to address the matter directly with your assigned instructor. Complaints first raised after completion of the course (e.g., the 20-hour driving element), particularly those made on the final day, and/or not supported by relevant evidence (e.g., audio or video), may be declined or not investigated. This clause does not affect your statutory rights

11.2 Based Liability Limitation

Fair Term Statement
We are committed to treating all clients fairly and handling any concerns with professionalism and transparency. This clause explains our approach to investigating complaints, including the type of evidence that helps us resolve issues effectively. It does not remove or limit any rights you have under UK law. All complaints will be considered in good faith, even if evidence is limited, and we will always investigate matters where required by safeguarding obligations, criminal law, DVSA requirements, or insurance procedures.

Requirement for Independent Evidence

The Client acknowledges and agrees that any allegation, claim, or dispute against the Company, its employees, agents, or contractors should be supported by independent, objective evidence. For the purposes of this Agreement, “independent, objective evidence” means verifiable proof originating from a source other than the Client or the accused party, including but not limited to written documentation, audio/video recordings, testimony from an unrelated third-party witness, or other evidence reasonably acceptable to the Company.

Uncorroborated Allegations

Where:
(a) the Client and the Instructor (or other Company representative) were the only persons present, and
(b) no independent, objective evidence exists,
the Company shall be under no contractual obligation to investigate or adjudicate such matter, However complaints will be considered in good faith, even if evidence is limited.

No Admission by Silence or Non-Action

A decision not to take action in relation to an uncorroborated allegation shall not be construed as an admission of any kind, however obligations under safeguarding, criminal law, DVSA requirements or insurance claims procedures. will still be investigated regardless of evidence.

Preservation of Statutory Rights

Nothing in this clause limits or excludes any liability which cannot be limited or excluded under applicable law, including the Company’s liability for death or personal injury caused by its negligence, fraud, or fraudulent misrepresentation, or any statutory rights of the Client.

11.3 Third-Party Inquiries

We are unable to discuss your course or complaint with any third party (including parents/ guardians) unless written consent is provided, in line with UK GDPR.

12. Force Majeure

5DAY® is not liable for delays or cancellations due to events beyond our control, including but not limited to:

DVSA test centre closures

Instructor illness / mechanical issues

National DVSA test delays or Test availability”

Refunds will only be issued where the Customer provides clear and objective evidence that the goods or services supplied have failed to meet the agreed specification or are otherwise not of satisfactory quality as defined under the Consumer Rights Act 2015. Unsupported claims or unsubstantiated allegations shall not give rise to any right to a refund. Any discretionary refunds outside of these statutory rights shall be at the sole discretion of management.”

In such cases, we will provide reasonable support but cannot guarantee alternative arrangements or refunds.

13. Legal Information

These Terms and Conditions do not affect your statutory consumer rights. Nothing in these terms excludes liability for death or personal injury caused by negligence. Calls may be recorded for training and quality purposes.
